Nature’s Work strongly recommends that all clients arrange appropriate personal accident, cancellation and travel insurance before participating in a course or activity.
It is the client’s responsibility to ensure that any insurance policy purchased provides adequate and appropriate cover for the activities booked, including, where relevant, mountain and outdoor activities, cancellation, curtailment, medical expenses, rescue and repatriation.
A copy of these Terms & Conditions, together with the relevant booking and information forms, will be provided to clients as part of the booking process.
A booking is not confirmed until Nature’s Work has received the required payment and has issued written confirmation of the booking.
Jim Langley, trading as Nature’s Work, accepts bookings subject to these Terms & Conditions.
1.1 Definitions
For the purposes of these Terms & Conditions:
“Deposit” means the initial payment required to secure a booking. Unless otherwise agreed in writing, this is 50% of the agreed course or activity price.
“Head Office” means:
Nature’s Work
5 Mount Park
Conwy
LL32 8RN
“Client” means the person or persons named on the booking form.
“Major Change” means a significant change to a confirmed booking, including a change to the dates, principal location or more than approximately 80% of the agreed course content.
“Force Majeure Event” means an event or circumstance beyond the reasonable control of Nature’s Work which could not reasonably have been prevented or avoided. This may include, for example, extreme or dangerous weather conditions, natural disasters, fire, war, terrorism, civil unrest, industrial disputes, serious transport disruption, government restrictions, road closures, or other circumstances which make the planned activity unsafe or impracticable.
“Course Director” means the person appointed by Nature’s Work to have responsibility for the delivery and management of the relevant course or activity.
Where “Client” refers to two or more persons, each Client is individually responsible for complying with these Terms & Conditions.
References to legislation include any amendment, extension, replacement or re-enactment of that legislation.
Words importing the singular include the plural and vice versa.
Headings are included for convenience and do not affect the interpretation of these Terms & Conditions.
2.1 A contract between Nature’s Work and the Client is formed when Nature’s Work issues written confirmation accepting the Client’s booking.
2.2 The contract consists of:
Any amendment to the agreed booking should be confirmed in writing.
2.3 Information provided by Nature’s Work before booking will be accurate to the best of our knowledge. Where information is subject to change because of weather, conditions, availability or other circumstances, we will make this clear.
Nothing in these Terms & Conditions excludes or limits any rights or protections that the Client has under applicable law.
3.1 To make a booking, Nature’s Work requires a completed booking form and, where applicable, an individual information or medical information form.
For bookings made more than 28 days before the course or activity:
For bookings made within 28 days of the course or activity start date, the full amount is payable at the time of booking.
3.2 Online bookings and bookings paid by BACS are payable in accordance with the payment requirements stated at the time of booking.
Where an invoice is requested, including for corporate bookings, the invoice will specify the payment deadline. Unless otherwise agreed in writing, the full amount must be paid before the course or activity begins.
3.3 A request for an invoice does not alter these Terms & Conditions unless Nature’s Work expressly agrees otherwise in writing.
3.4 Large group or corporate bookings may be subject to specific payment and cancellation arrangements agreed in writing before the booking is confirmed.
3.5 Nature’s Work reserves the right to decline a booking where it has a reasonable basis for doing so.
Telephone or email enquiries may be treated as provisional until Nature’s Work confirms the booking in writing and the required payment has been received.
3.6 If the balance is not paid by the required payment date, Nature’s Work may contact the Client to request payment and, where payment remains outstanding, may treat the booking as cancelled by the Client, subject to applicable law and the cancellation provisions below.
4.1 The price confirmed at the time of booking covers the planning, organisation and delivery of the agreed course or activity, together with any inclusions expressly stated in the booking confirmation.
4.2 Once a booking has been confirmed, the agreed price will not be increased except where:
Any additional costs will be explained to the Client before they are incurred wherever reasonably practicable.
4.3 Unless otherwise stated in writing, the Client is responsible for arranging and paying for travel to and from the activity location.
The Client is also responsible for personal clothing, footwear, medication and other personal equipment unless Nature’s Work has specifically agreed to provide such items.
5.1 A Client may cancel a booking by providing written notice by email or post to Nature’s Work.
Cancellation takes effect on the date Nature’s Work receives the written cancellation notice.
5.2 The amount retained by Nature’s Work following cancellation will reflect the agreed cancellation terms and, where applicable, the reasonable costs and losses Nature’s Work is likely to incur as a result of the cancellation.
Unless otherwise agreed in writing, the following cancellation charges will apply:
Notice received before the course/activity – Cancellation charge
29 days or more – Deposit of 50%
15–28 days – 75% of the total price
14 days or less – 100% of the total price
5.3 The cancellation charges are intended to reflect the costs and losses reasonably incurred by Nature’s Work as a result of cancellation, including planning, administration, staffing, supplier commitments and the loss of the opportunity to resell the course or activity place.
Where Nature’s Work is able to resell a cancelled place, we may take that into account when calculating any amount retained or refunded, subject to any non-recoverable costs already incurred.
5.4 Nothing in this section is intended to limit any statutory cancellation or refund rights that cannot legally be excluded.
5.5 Clients are strongly advised to obtain cancellation insurance to protect against circumstances where they are unable to attend.
6.1 Course and activity bookings are specific to the dates and arrangements stated in the booking confirmation.
Requests to change the date, location, participants or agreed programme will be considered at Nature’s Work’s discretion and are subject to availability.
6.2 A change requested by the Client may result in additional reasonable costs, which will be explained before the change is confirmed.
6.3 A request to move a booking to another date is not automatically available and will only be confirmed when agreed in writing by Nature’s Work.
7.1 Nature’s Work will make reasonable efforts to deliver every confirmed course or activity as booked. However, circumstances may arise where cancellation is necessary.
If Nature’s Work cancels a confirmed booking for reasons within its reasonable control before the course or activity begins, the Client will normally be offered:
7.2 Where appropriate, and where required by law, Nature’s Work may also provide reasonable compensation.
7.3 Force Majeure
Nature’s Work may need to cancel, postpone or substantially alter an activity because of a Force Majeure Event.
Where this occurs, Nature’s Work will communicate with affected Clients as soon as reasonably practicable and will explain the options available.
Where the law permits, Nature’s Work will not be responsible for indirect or consequential costs incurred by the Client as a result of a Force Majeure Event, such as travel, accommodation or other arrangements booked independently by the Client.
Clients should therefore ensure that they have appropriate cancellation and travel insurance.
Nothing in this clause excludes any refund or other rights that cannot legally be excluded.
8.1 Nature’s Work makes every reasonable effort to ensure that information published on its website, literature and booking documentation is accurate.
Activities undertaken in mountain and outdoor environments are inherently affected by weather, ground conditions, access restrictions, safety considerations and the abilities of participants.
8.2 If Nature’s Work needs to make a significant change to a confirmed booking before it begins, we will inform the Client as soon as reasonably practicable.
Depending on the circumstances and applicable law, Nature’s Work may offer:
8.3 Where a minor change is required, Nature’s Work may make the change without offering a refund where the change does not materially affect the overall nature of the booking.
8.4 If Nature’s Work is unable to provide a significant part of the agreed service, we will make reasonable efforts to provide a suitable alternative. Where appropriate, a proportionate refund may be provided for services that have not been provided.
9.1 Published course programmes are intended to provide an indication of the nature, scope and type of activities involved. They are not a guarantee that a particular route, summit, location or activity will be completed.
Mountain and outdoor activities are affected by weather, ground and mountain conditions, access restrictions, participant fitness, experience, equipment and other factors.
9.2 The Course Director, guide, instructor or activity leader has responsibility for making operational and safety decisions during the course.
They may change routes, locations, objectives, activities or timings where they consider this necessary or appropriate for safety, weather, environmental conditions, participant ability or other relevant circumstances.
9.3 This may include changing the planned objective even where a particular mountain, route or activity was identified as the principal objective of the course.
9.4 Where possible, Nature’s Work will inform Clients of significant changes before or during the course.
9.5 Some courses may include additional or contingency days to allow flexibility in response to weather and other conditions.
Where a course ends earlier than planned because the agreed course objectives have been achieved or because the group and Course Director reasonably determine that returning early is appropriate, the Client remains responsible for any additional personal costs arising from changes to their own travel or accommodation arrangements.
10.1 Nature’s Work staff, guides and instructors will use reasonable endeavours to deliver the course safely and effectively for the benefit of all participants.
10.2 Clients must follow reasonable instructions given by Nature’s Work staff, guides, instructors and activity leaders where those instructions relate to safety, conduct or the proper delivery of the activity.
10.3 Clients must not behave in a way that:
10.4 Where a Client is unable or unwilling to participate safely, or behaves in a way that materially affects the safety or wellbeing of the group, Nature’s Work may require the Client to stop participating or, where necessary, leave the activity.
10.5 Where a Client is removed from an activity because of their own conduct, failure to follow reasonable safety instructions, or inaccurate or incomplete information provided by them, they will normally not be entitled to a refund and may be responsible for reasonable additional costs arising from their removal.
This clause does not limit any rights the Client may have under applicable law.
11.1 Clients must provide accurate and complete information that Nature’s Work reasonably requires to assess their suitability for the booked activity and to manage safety.
Clients should notify Nature’s Work of any medical condition, medication, allergy, injury, disability or other relevant circumstance that could reasonably affect their ability to participate safely.
11.2 Nature’s Work may process relevant health information for safety and activity-management purposes in accordance with its Privacy Policy and applicable data protection legislation.
Health information is special category personal data under the UK GDPR and is subject to additional legal protections. (ICO)
11.3 Providing relevant health and safety information does not guarantee that a Client will be permitted to participate in every activity. Nature’s Work may need to modify an activity or, where reasonably necessary for safety, decline participation in a particular activity.
11.4 If a Client knowingly provides materially inaccurate or incomplete information relevant to their safety, Nature’s Work may need to withdraw them from the activity.
Any decision to do so will be made on reasonable safety grounds and will take account of the circumstances.
12.1 Mountain, climbing, walking and other outdoor activities involve inherent risks, including risks arising from weather, terrain, falling rocks, slips and falls, water, altitude, remoteness, natural hazards, equipment failure and the actions of other people.
Nature’s Work takes reasonable steps to manage and reduce foreseeable risks but cannot eliminate all risks inherent in outdoor activities.
12.2 Clients must follow reasonable safety instructions and must use equipment appropriately.
12.3 Nothing in these Terms & Conditions excludes or restricts liability where such exclusion or restriction would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
13.1 Nature’s Work may use suitably qualified and appropriately experienced instructors, guides, activity providers or other subcontractors to deliver elements of a course or activity.
13.2 Nature’s Work will take reasonable steps to ensure that subcontractors engaged to deliver activities are appropriately qualified, experienced and suitable for the services they provide.
13.3 Where activities involving children or young people fall within the scope of the Adventure Activities Licensing scheme, Nature’s Work will comply with applicable licensing requirements. The AALA licensing requirements apply to specified adventure activities for under-18s in England, Wales and Scotland. (GOV.UK)
14.1 If a Client experiences a problem during a course or activity, they should report it to the instructor, guide or Course Director as soon as reasonably possible.
This gives Nature’s Work the opportunity to investigate and, where reasonably possible, resolve the issue during the activity.
14.2 If the matter cannot be resolved during the course or activity, the Client should contact Nature’s Work as soon as reasonably possible after completion.
14.3 Any formal complaint should preferably be submitted in writing within 28 days of the completion of the relevant course or activity.
The complaint should include the booking reference, details of the Client or group, the nature of the complaint and any relevant supporting information.
A failure to report a problem promptly may make it more difficult for Nature’s Work to investigate and resolve the matter, but it will not automatically remove any statutory rights the Client may have.
15.1 Nature’s Work may reasonably amend operational arrangements where necessary to reflect changes in safety requirements, weather, access, environmental conditions or other circumstances affecting the delivery of an activity.
15.2 The Course Director or appointed deputy is responsible for operational decisions during the course, including decisions about routes, locations, timings and activities.
15.3 The Course Director’s decisions concerning immediate safety should be followed by all participants.
15.4 All activity itineraries are subject to prevailing weather, terrain, access conditions and the ability, fitness and experience of the participants.
16.1 Nature’s Work strongly recommends that Clients obtain suitable personal accident, cancellation and travel insurance before participating in a course or activity.
16.2 Clients should check that their policy specifically covers the activities they intend to undertake, including any relevant mountain, climbing, trekking, water or other adventure activities.
16.3 Nature’s Work is not responsible for costs that could reasonably have been covered by an appropriate insurance policy purchased by the Client, except where Nature’s Work is legally responsible for those costs.
17.1 Nature’s Work processes personal information in accordance with applicable data protection legislation, including the UK GDPR and Data Protection Act 2018, as applicable.
17.2 Information provided through booking and individual information forms may be used to administer the booking, communicate with the Client, provide the agreed services, manage health and safety, deal with emergencies and meet legal, accounting and insurance requirements.
17.3 Further information is contained in the Nature’s Work Privacy Policy.
18.1 A booking is personal to the Client and may not be transferred to another person without the prior written agreement of Nature’s Work.
18.2 Any request to substitute another participant will be considered on a case-by-case basis and may be subject to additional reasonable costs or requirements.
Unless expressly stated otherwise, no person other than Nature’s Work and the Client has any right to enforce the terms of this agreement under the Contracts (Rights of Third Parties) Act 1999.
This does not affect any rights or remedies that a person may have independently under applicable law.
Nature’s Work may update these Terms & Conditions from time to time.
The version applicable to a booking will normally be the version provided to the Client at the time the booking is confirmed.
Changes made after a booking has been confirmed will not retrospectively remove or reduce rights that the Client has under the contract or applicable law.
These Terms & Conditions and any contract between Nature’s Work and the Client shall be governed by the law of England and Wales.
Subject to any mandatory consumer rights concerning jurisdiction, the courts of England and Wales shall have jurisdiction in relation to disputes arising from the contract.
Nothing in this clause prevents a consumer from relying on any mandatory rights or protections available to them under applicable law.
